SUTASI Talent Search Contest 2009/2010 – OFFICIAL TALENT CONTEST RULES

INTRODUCTION. Asia Sounds Film & T.V., LLC, a California Limited Liability Company located at 9503 Jefferson Blvd, Culver City, California 90232 USA (the “Sponsor”), invite you to enter your recorded performance for consideration to be included in the SUTASI Southeast Asian talent search contest (the “Talent Contest”), which gives performers in eligible territories the opportunity to have their performances considered to be a finalist in SUTASI (the “Program”) as described below.  The details of how to enter the Talent Contest and the Prize (defined below) are contained in these “Official Talent Contest Rules”.

ENTRY PROTOCOL.  The Talent Contest must be entered during the “Talent Contest Submission Period” (defined below) by completing and submitting an entry packet.  Each entry packet must include: (A) a completed and signed official SUTASI Talent Search Contest Application and Release Agreement (the “Application”) for each performer AND each songwriter [if the song embodied on the recorded performance being submitted is an original composition by someone other than the performer(s)] (download the Application here http://www.sutasi.com).  All signatures on the Application(s) must be original and each and every individual controlling rights in the submitted recording must complete the Application.  PLEASE TYPE OR PRINT CLEARLY AND NEATLY IN ENGLISH; (B) a recording of your performance (the “Recording”) in Compact Disc (CD) format containing one (1) recording of one (1) song only, five (5) minutes or less in length.  CDs must be clearly labeled with the name of the performer, the title of the song and a phone number and email address for the entrant(s).  APPLICATIONS MAY ALSO BE SUBMITTED BY FACSIMILE (FAX) AND MP3’S WILL ALSO BE ACCEPTED.  Any entrant who wishes to submit an MP3 must indicate such on the Application.  Once the Application is received, Sponsor will email entrant with instructions for MP3 submission.  Applications to be submitted by fax should be sent to +613 9974 2926. (C) a headshot or other photograph which clearly show’s entrant’s likeness close-up; and, (D) a basic lead sheet for the song embodied in the Recording with the song title, the performer’s name and the name of the composer of the song centered at the top of the lead sheet and showing the song’s key, time signature, tempo, chord changes, melody and lyrics and an English translation of all lyrics, if applicable and each complete entry packet must be received by Sponsor at the following address: SUTASI Talent Search, C/O Asia Sounds Pty Ltd
44A Watton Street, Level 1 Werribee, Victoria, Australia 3030. The Recording cannot contain any so-called “samples” or other materials that are proprietary to anyone other than the entrants.  The Recording must not infringe upon copyrights or any other rights of anyone.  The Sponsor reserves the right, in Sponsor’s sole and unfettered discretion, to disqualify at any time during the Talent Contest any recording submitted based on the belief that such recording contains any materials that may infringe on the rights of any third parties or any material that Sponsor in its sole discretion deems to be obscene, profane or offensive.
One (1) entry packet containing all elements as set forth herein must be received by the Sponsor in connection with the Recording during the Talent Contest Submission Period and any entrant or group or ensemble of entrant(s) may enter only ONE (1) entry into the Talent Contest (i.e., a solo performer who enters one recording may NOT also enter a recording as part of a group or ensemble).  Incomplete submissions may be disqualified without notice to the entrant.  ALL SIGNATURES MUST BE ORIGINAL.
Each entrant must have reached the age of majority (i.e., the age of consent for the purposes of entering into contracts) in their country of nationality.

The Sponsor is not responsible for lost, late, incomplete, garbled, illegible, or misdirected Talent Contest entries, or for any error, human, technical or otherwise, which may occur in the processing of Talent Contest entries.  Proof of sending or delivery of any entry materials will not be deemed to be proof of receipt by the Sponsor.  All entry packets become the exclusive property of Sponsor and will not be acknowledged or returned.

Entrants retain ownership of submitted recordings and the songs embodied thereon; provided, however, that entry constitutes permission to use of all entrants’ names, likenesses and voices, songs and any recording submitted for all of Sponsor’s future publicity and advertising purposes without compensation and Sponsor shall have an irrevocable, perpetual, universe-wide, fully paid-up and royalty-free license to copy all submitted recordings and the songs embodied thereon (including, without limitation, by means of re-recording songs and making mechanical reproductions of songs, creating digital files from submitted recordings to be streamed on the Internet or by wireless networks or made available for download, as a ringtone, ringback tone, etc.), and to use, re-use, publish and re-publish such works in whole or in part, individually or in conjunction with other recordings or songs, in any and all media now known or hereafter devised and for any purpose whatsoever throughout the universe, and to use the name of each entrant in connection therewith if Sponsor so chooses in its sole discretion.

CDs, Applications, lead sheets and any and all other materials submitted to Sponsor will not be returned, so a master copy of the Recording should not be submitted.  Talent Contest entries will not be critiqued.

TIMING.  The Talent Contest begins at 12:00:01 a.m. local time in Melbourne, Australia (GMT +10 hours) on Thursday January 1, 2009, and all entry packets must be received by Sponsor no later than 11:59:59 p.m. local time in Melbourne, Australia (GMT +10 hours) on Friday July 31, 2009 (the “Talent Contest Submission Period”).  Entries received prior to or after the Talent Contest Submission Period are disqualified.  Sponsor reserves the right in Sponsor’s sole discretion to end the Talent Contest Submission Period early in the event that one thousand (1,000) or more entries to the Talent Contest are received by Sponsor at any time prior to the end of the Talent Contest Submission Period.

ELIGIBILITY REQUIREMENTS.  This competition is open to all amateur performers who are citizens of Vietnam, Cambodia, Brunei, Laos, Myanmar, Malaysia, East Timor, Philippines, Indonesia, Singapore, Thailand, China, Japan, North Korea, South Korea, Taiwan, Hong Kong SAR, Macau SAR, India, Nepal, Sri Lanka, Pakistan, Bhutan, Bangladesh and Maldives.  Any entrant who, as of the commencement of the Talent Contest Submission Period, is party to an exclusive recording agreement, exclusive publishing agreement, agency agreement or other personal services contract in the entertainment industry or any other contractual arrangement which may prevent any Finalist (defined below) from signing to an exclusive recording, publishing, management, merchandising, agency or other personal services agreement with Sponsor are not eligible to enter into the Talent Contest.  In addition, persons who are, as of the commencement of the Talent Contest Submission Period, employees or immediate family members (which shall include parents, siblings, grandparents, spouses, half siblings, children, grandchildren, and sons or daughters-in-law) of employees of the Sponsor, participating television stations, television production personnel, advertising agencies or any other person connected with the production, administration or judging of the Talent Contest or the Program or any of their respective parent companies, affiliates, subsidiaries, successors and assigns and the respective officers, directors, employees, agents, attorneys, contractors, partners, shareholders and members of each of the foregoing shall not be eligible for entry into the Talent Contest. 

FINALIST SELECTION PROTOCOL.  Twelve (12) entries will be selected as finalists (the “Finalists”) by a panel of music industry professionals (which panel shall be chosen by Sponsor in Sponsor’s sole discretion) from all complete entries actually received by the Sponsor.  The songs are judged on, vocal quality and originality of performance and appearance, vocal range, vocal proficiency, confidence, composition choice and creative compatibility with Sponsor’s stated goal of showcasing contemporary Asian performer talent.  All decisions of Sponsor are final.  Songs may be in any language provided that a translation of lyrics is furnished as required herein.  The Finalists will be streamed on the Sponsor’s website (http://www.Sutasi.com) and the public, along with a panel of industry professionals, will have an opportunity to vote on the Finalists in accordance with these rules.

FINALIST NOTIFICATION.  The Finalists will be notified by mail, email or telephone and must sign and return any and all documentation deemed necessary by the Sponsor and/or any other consent with original signatures from all parties representing 100% of the rights in and to each potential Finalist recording and/or song embodied thereon.  Failure to sign and return any such documentation promptly after Sponsor’s request therefore will result in immediate disqualification and an alternate Finalist may be selected by Sponsor.  Finalists will also be subject to such other requirements as Sponsor may deem necessary in its sole discretion, including, without limitation, interviews, health examinations and background checks and Finalists must fully cooperate with Sponsor in these matters.  Failure by any Finalist to fully cooperate with Sponsor as determined by Sponsor in Sponsor’s sole discretion may result in disqualification and an alternate Finalist may be selected by Sponsor.  The list of Finalists will be determined on or around July 31, 2009.

WINNER SELECTION PROTOCOL.  Once a qualifying list of Finalists is determined in accordance herewith, the Finalists will perform in front of a live audience and such performance will be filmed for potential inclusion as part of the Program.  A panel of no fewer than six (6) respected music industry professionals from around the world will rate the Finalists in order of preference, awarding their first preference twelve (12) points, eleven (11) points to their second preference, etc.  A seventh “judge” will be comprised of the voting public, who will SMS or text message their votes.  The performer that receives the most public votes will receive twelve (12) points, eleven (11) points will be awarded to the performer receiving the second largest number of public votes, and so on.  The performer that receives the largest total score from the seven (7) judges will be the winning song (the “Winner”).  Sponsor’s decisions as to all matters related to administration of the Talent Contest and selection of the Finalists and the Winner are final.  All Finalists must comply with all terms and conditions set forth in these Official Talent Contest Rules, and winning is contingent upon fulfilling all requirements set forth herein or otherwise required by the Sponsor or the Sponsor’s assigns.

PRIZE.  The Winner will receive international exposure for their performance ability and talent, will be given an exclusive recording, publishing, management and agency agreement with top industry professionals and will be positioned to emerge as an internationally recognized performer (the “Prize”).  Odds of winning depend on the number of eligible entries received during the entire Talent Contest Submission Period.

The Prize is subject to the following material conditions and restrictions:

All federal, state and local taxes related to the Prize, if any, are the sole responsibility of the Winner.  All other expenses and costs, not expressly listed above, including but not limited to applicable taxes, are the Winner’s sole responsibility.  No transfer or assignment of the Prize is permitted.  The Winner must execute and return to Sponsor Sponsor’s standard form publishing agreement, standard form personal management agreement, standard form exclusive recording agreement, standard form agency agreement and any other agreements that Sponsor may deem necessary. 

Except where prohibited by law, the Finalists each grant to Sponsor and its advertising agencies the right to use and publish each Finalist’s photo, video footage embodying each Finalist, each Finalists’ proper name, likeness, voice, opinions, biographical information and state in any media to promote Sponsor and the Talent Contest without compensation.

Sponsor reserves the right to cancel or modify the Talent Contest if fraud or any other factor impairs the integrity of the Talent Contest as determined by Sponsor in its sole discretion.

If, in the Sponsor’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Talent Contest, or if technical difficulties compromise the integrity of the Talent Contest, the Sponsor reserves the right in its sole discretion to void any entries at issue (including disqualifying any individual who tampers with the entry process), and to cancel, terminate, modify or suspend the Talent Contest, in whole or in part, at any time without notice.

RIGHTS AND INDEMNIFICATION.  By entering the Talent Contest or submitting recordings to the Sponsor, all entrants release, hold harmless and indemnify the Sponsor, their employees, agents, and affiliates against all first, second and third party claims arising from any song and/or recording submitted which violates any of the Official Talent Contest Rules or is the result of any breach of any warranty, representation, covenant or agreement in the Application and from any and all liability for any injuries or damage of any kind arising from or in connection with the Talent Contest. The Sponsor is not responsible for late, lost, damaged or postage due entries or for any problems or delays arising from mail carrier, common carrier or courier failure or malfunction. The Sponsor reserves the right to disqualify any entry that does not meet the requirements herein outlined at any time.

USE OF DATA.  The Sponsor will be collecting personal data about entrants (including, without limitation, e-mail addresses) who enter the Talent Contest.  By participating in the Talent Contest, entrants hereby agree to all personal information uses and disclaimers as explained in the Sponsor’s Privacy Policy http://www.sutasi.com

AGREEMENT TO OFFICIAL RULES.  Participation in the Talent Contest constitutes entrant’s full and unconditional agreement to and acceptance of these Official Talent Contest Rules and Sponsor’s Privacy Policy http://www.sutasi.com and to be contacted by telephone and/or email.

GENERAL CONDITIONS.

1.  The Talent Contest is governed by the laws of the United States and the State of California, and by entering the Talent Contest entrants in the Talent Contest consent to the exclusive jurisdiction and venue of California courts for any causes or controversies arising out of the Talent Contest (though jurisdiction and venue in California is expressly non-exclusive hereunder and Sponsor may elect to waive jurisdiction or venue in California in Sponsor’s sole discretion). All applicable federal, state and local laws and regulations apply except in the governance of the Talent Contest, as set forth herein. Void where prohibited. If for any reason any provision or provisions herein are determined to be indefinite, invalid, contrary to any applicable existing or future laws or otherwise unenforceable, that shall not impair the operation or effect of any other portion of these Official Talent Contest Rules or the Application, and these Official Talent Contest Rules and/or the Application shall be deemed modified, but only to the extent necessary to make the provision or provisions in question enforceable. 
2.  The Sponsor reserves the right to cancel or modify the Talent Contest if fraud or any other factor impairs the integrity of the Talent Contest as determined by the Sponsor in Sponsor’s sole discretion.  If, in the Sponsor’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Talent Contest, or if technical difficulties compromise the integrity of the Talent Contest, the Sponsor reserves the right in their sole discretion to disqualify any entrant(s) who tamper(s) with the voting process, and to cancel, terminate, modify or suspend the Talent Contest, in whole or in part, at any time without notice. 

3.  The Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction of unauthorized access to, or alteration of, entries.  Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any vote received by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site, any combination thereof, or otherwise, including any injury or damage to entrant’s or any other person’s computer related to or resulting from participation or voting in or in connection with the Talent Contest.  Sponsor is not responsible for and shall not be liable for any printing, typographical or technological errors in any materials associated with the Talent Contest administration, judging and auditioning process. 

4.  Each entrant agrees that he or she will not be compensated for submitting recordings or the songs embodied thereon, regardless of whether the entrant of such recording is selected as a Finalist or such recording or the song embodied thereon is otherwise used by the Sponsor in any manner.  By entering the Talent Contest, each entrant agrees to release and discharge the Sponsor and all of Sponsor’s licensees and assigns and all media and production companies affiliated with or associated with the production and/or broadcast or webcast of the Program, and the respective parents, subsidiaries, affiliates, licensees, successors or assigns and the respective directors, officers, employees, agents, contractors, partners, shareholders, representatives, attorneys and members of each of the foregoing entities, their respective heirs, executors, assigns and designees from any and all claims and demands arising out of or in connection with the use of their songs or recordings, in whole or in part, including, without limitation, any claims for copyright infringement, defamation or invasion or privacy. 

5.  The Sponsor reserves the right to amend, append and update these Official Talent Contest Rules at any time during the Talent Contest without notice to any entrant or other person. 

CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE TALENT CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO DISQUALIFY SUCH PERSON FROM THE TALENT CONTEST AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

IF ANY ENTRANT OR THEIR FAMILY MEMBER, FRIEND OR ANYONE ELSE ACCOMPANYING HIM OR HER TO ANY AUDITION, INTERVIEW OR OTHER TAPING IN CONNECTION WITH THE PROGRAM OR THE TALENT CONTEST DOES NOT WISH TO BE PHOTOGRAPHED OR DOES NOT AGREE WITH THESE TERMS, HE OR SHE SHOULD NOT ATTEND THE AUDITIONS OR INTERVIEWS AND SHOULD NOT ENTER ANY VENUE WHERE SUCH AUDITIONS OR INTERVIEWS ARE TAKING PLACE. 

NO WEAPONS, ALCOHOL OR NON-PRESCRIPTION CONTROLLED SUBSTANCES WILL BE PERMITTED AT ANY AUDITION OR DURING THE TALENT CONTEST OR ANY TAPING OR OTHER ENGAGEMENT IN CONNECTION WITH THE PROGRAM.

One (1) complete entry packet containing all elements as set forth herein must be received by the Sponsor prior to the end of the Submission Period for each song submitted.  Entrants may enter as many songs as they like, but each entry requires a separate entry packet containing all items set out above.  Incomplete submissions may be disqualified without notice to the entrant. ALL SIGNATURES MUST BE ORIGINAL.

FINALIST NOTIFICATION.  The Finalists will be notified by mail, email or telephone and must sign and return any and all documentation deemed necessary by the Sponsor and/or any other consent with original signatures from all parties representing 100% of the rights in and to each potential Finalist song.  Failure to sign and return any such documentation promptly after Sponsor’s request therefore will result in immediate disqualification and an alternate Finalist may be selected by Sponsor.  Finalists will also be subject to such other requirements as Sponsor may deem necessary in its sole discretion, including, without limitation, interviews, health examinations and background checks and Finalists must fully cooperate with Sponsor in these matters.  Failure by any Finalist to fully cooperate with Sponsor as determined by Sponsor in Sponsor’s sole discretion may result in disqualification and an alternate Finalist may be selected by Sponsor.  The list of Finalists will be determined on or around December 5, 2007.

WINNER SELECTION PROTOCOL.  Once a qualifying list of Finalists is determined in accordance herewith, the Finalist songs will be performed in front of a live audience and such performance of each song will be filmed for potential inclusion as part of the Program.  A panel of no fewer than five (5) respected music industry professionals from around the world will rate the Finalists in order of preference, awarding their first preference twelve (12) points, eleven (11) points to their second preference, etc.  A sixth “judge” will be comprised of the voting public, who will SMS or text message their votes.  The song that receives the most public votes will receive twelve (12) points, eleven (11) points will be awarded to the song receiving the second largest number of public votes, and so on.  The song that receives the largest total score from the six (6) judges will be the winning song (the “Winner”).  Sponsor’s decisions as to all matters related to administration of the Song Contest and selection of the Finalists and the Winner are final.  All Finalists must comply with all terms and conditions set forth in these Official Song Contest Rules, and winning is contingent upon fulfilling all requirements set forth herein or otherwise required by the Sponsor or the Sponsor’s assigns.

PRIZE.  The Winner will receive international exposure for their song and their writing talent, will be given a publishing, management, recording and agency agreement with top industry professionals and will be positioned to emerge as an internationally recognized composer (the “Prize”).  Odds of winning depend on the number of eligible entries received during the entire Submission Period.

The Prize is subject to the following material conditions and restrictions:

All federal, state and local taxes related to the Prize, if any, are the sole responsibility of the Winner.  All other expenses and costs, not expressly listed above, including but not limited to applicable taxes, are the Winner’s sole responsibility.  No transfer or assignment of the Prize is permitted.  The Winner must execute and return to Sponsor Sponsor’s standard form publishing agreement, standard form personal management agreement, standard form exclusive recording agreement, standard form agency agreement and any other agreements that Sponsor may deem necessary. 

Except where prohibited by law, the Finalists each grant to Sponsor and its advertising agencies the right to use and publish each Finalist’s photo(s), video footage embodying the Finalist(s), each Finalist’s proper name, likeness, voice, opinions, biographical information and state in any media to promote Sponsor and the Song Contest without compensation.

Sponsor reserves the right to cancel or modify the Song Contest if fraud or any other factor impairs the integrity of the Song Contest as determined by Sponsor in its sole discretion.

If, in the Sponsor’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Song Contest, or if technical difficulties compromise the integrity of the Song Contest, the Sponsor reserves the right in its sole discretion to void any entries at issue (including disqualifying any individual who tampers with the entry process), and to cancel, terminate, modify or suspend the Song Contest, in whole or in part, at any time without notice.

RIGHTS AND INDEMNIFICATION.  By entering the Song Contest or submitting any songs or recordings to the Sponsor, all entrants release, hold harmless and indemnify the Sponsor, their employees, agents, and affiliates against all first, second, and third party claims arising from any song and/or recording submitted which violates any Official Song Contest Rules or is the result of any breach of any warranty, representation, covenant or agreement in the Application and from any and all liability for any injuries or damage of any kind arising from or in connection with the Song Contest. The Sponsor is not responsible for late, lost, damaged or postage due entries or for any problems or delays arising from mail carrier, common carrier or courier failure or malfunction. The Sponsor reserves the right to disqualify any entry that does not meet the requirements herein outlined at any time.

USE OF DATA.  The Sponsor will be collecting personal data about entrants (including, without limitation, e-mail addresses) who enter the Song Contest.  By participating in the Song Contest, entrants hereby agree to all personal information uses and disclaimers as explained in the Sponsor’s Privacy Policy http://www.sutasi.com

AGREEMENT TO OFFICIAL RULES.  Participation in the Song Contest constitutes entrant’s full and unconditional agreement to and acceptance of these Official Song Contest Rules and Sponsor’s Privacy Policy http://www.sutasi.com and to be contacted by telephone and/or email.

GENERAL CONDITIONS.

1.  The Song Contest is governed by the laws of the United States and the State of California, and by entering the Song Contest entrants in the Song Contest consent to the jurisdiction and venue of California courts for any causes or controversies arising out of the Song Contest (though jurisdiction and venue in California is expressly non-exclusive hereunder and Sponsor may elect to waive jurisdiction or venue in California in Sponsor’s sole discretion).  All applicable federal, state and local laws and regulations apply except in the governance of the Song Contest, as set forth herein.  Void where prohibited.  If for any reason any provision or provisions herein are determined to be indefinite, invalid, contrary to any applicable existing or future laws or otherwise unenforceable, that shall not impair the operation or effect of any other portion of these Official Song Contest Rules or the Application, and these Official Song Contest Rules and/or the Application shall be deemed modified, but only to the extent necessary to make the provision or provisions in question enforceable. 

2.  The Sponsor reserves the right to cancel or modify the Song Contest if fraud or any other factor impairs the integrity of the Song Contest as determined by the Sponsor in Sponsor’s sole discretion.  If, in the Sponsor’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Song Contest, or if technical difficulties compromise the integrity of the Song Contest, the Sponsor reserves the right in their sole discretion to disqualify any entrant(s) who tamper(s) with the voting process, and to cancel, terminate, modify or suspend the Song Contest, in whole or in part, at any time without notice. 

3.  The Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction of unauthorized access to, or alteration of, entries.  Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any vote received by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site, any combination thereof, or otherwise, including any injury or damage to entrant’s or any other person’s computer related to or resulting from participation or voting in or in connection with the Song Contest.  Sponsor is not responsible for and shall not be liable for any printing, typographical or technological errors in any materials associated with the Song Contest administration, judging and auditioning process. 

4.  Each entrant agrees that he or she will not be compensated for submitting any song or recording, regardless of whether such song or recording is selected as a Finalist or is otherwise used by the Sponsor in any manner.  By entering the Song Contest, each entrant agrees to release and discharge the Sponsor and all of Sponsor’s licensees and assigns and all media and production companies affiliated with or associated with the production and/or broadcast or webcast of the Program, and the respective parents, subsidiaries, affiliates, licensees, successors or assigns and the respective directors, officers, employees, agents, contractors, partners, shareholders, representatives, attorneys and members of each of the foregoing entities, their respective heirs, executors, assigns and designees from any and all claims and demands arising out of or in connection with the use of their songs or recordings, in whole or in part, including, without limitation, any claims for copyright infringement, defamation or invasion or privacy. 

5.  The Sponsor reserves the right to amend, append and update these Official Song Contest Rules at any time during the Song Contest without notice to any entrant or other person. 

CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SONG CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO DISQUALIFY SUCH PERSON FROM THE SONG CONTEST AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

IF ANY ENTRANT OR THEIR FAMILY MEMBER, FRIEND OR ANYONE ELSE ACCOMPANYING HIM OR HER TO ANY AUDITION, INTERVIEW OR OTHER TAPING IN CONNECTION WITH THE PROGRAM OR THE SONG CONTEST DOES NOT WISH TO BE PHOTOGRAPHED OR DOES NOT AGREE WITH THESE TERMS, HE OR SHE SHOULD NOT ATTEND THE AUDITIONS OR INTERVIEWS AND SHOULD NOT ENTER ANY VENUE WHERE SUCH AUDITIONS OR INTERVIEWS ARE TAKING PLACE. 

NO WEAPONS, ALCOHOL OR NON-PRESCRIPTION CONTROLLED SUBSTANCES WILL BE PERMITTED AT ANY AUDITION OR DURING THE SONG CONTEST OR ANY TAPING OR OTHER ENGAGEMENT IN CONNECTION WITH THE PROGRAM.
